I’ll take it, I can’t get excited. This case is what the lawyers call a “bad vehicle.” US marriage equality isn’t safe, and this is a far less significant move by SCOTUS than allowing the passport policy to go back into effect days ago. Live to fight another day, but not a lick of credit to SCOTUS.

There is, weirdly, something to that, and it is very, weirdly, encouraging - even while Rehnquist Revolution and Fed Soc laid so much of the legal foundations for this crisis.

Contra the author, I think this is exactly why the “material support” laws were always a bad idea.

Eventually we should get rid of sex/gender on passports too. It wasn’t on them before 1978. But that was already a long game for multiple reasons; in addition to the one stated above, it would take changing current international standards.

You’re both right. I helped secure the passport policy. It wasn’t ever the place to start with removing sex markers. But we need to do that, more than ever. We should start with birth certificates - the AMA endorsed that years ago and activist orgs just … ignored it, I’ve never understood why.
