I could be wrong but I think the president has sole authority to order a launch. It would not be an illegal order. It could be crazy, horrific, maniacal etc. - but not illegal. But I think your larger point is true - top brass will not be a bulwark.

The indictment and legal battle will be financially and emotionally draining for Comey and his family. Whatever else Trump hopes to accomplish, making Comey suffer is surely one of his goals. He doesn't need a conviction to do that.
