To truly understand a case, a law student should be able to understand the arguments made by the prosecution and the defense to the jury, and then to the appellate courts. I think it would ground the future practitioners in a better understanding of how these issues are resolved.

My biggest pet peeve about the way they teach criminal law is that we forget that the case could have always disappeared from the caselaw pipeline if the jury acquitted. But all the academics act like if that off-ramp doesn’t exist.
