The one consistent thing with illegal orders is that "innocent people" always get hurt or die as a result of the illegal order, without exception. That's the reason why they are classified as illegal. There is no gray area there should be "no appeal" once a ruling is made on the facts and evidence.

Believing that anyone who lives in Washington State would travel all the way to Washington DC just to shoot two nondescript National Guardsmen is a little far-fetched. Sorry there must be more to the story.
