To fair, since X has stopped using it, they have effectively abandoned the trademark. Not a lawyer, but Google tells me that they will lose the trademark after 3 years of nonuse, which would be next year, I believe

IIRC the new episodes made weren't permanently HBO exclusives, so it's possible they didn't see it as valuable as something that people couldn't see on PBS later. I still think it's dumb as this was the only reason my family was consistently watching Max, but corporations gonna corporate, I guess 🤷🏻
