Clearly being in swimwear around members of either sex is lawful or swimming pools would be required to be single sex, which they aren’t.

You can change as much as one likes in the shower cubicle (hence many gyms having cubicled swimming pool changing villages), and many changing rooms do not have showers. Have an option of a private showering and changing room for those who do not want to be seen clothed in front of others.

You can be challenged, and if the person who perceived you as ‘clearly male’ was wrong they could be sued, and if the ‘challenge& is harassing. Noting that ‘clear sex’ is not legal terminology; the SC didn’t give guidance on sex assessment.

Or they could make changing booths private for everyone.

If they do nothing they risk legal claims, if they intervene they risk legal claims.

Or they can make the changing rooms single occupancy booths. Not sure anyone really wants to be naked around anyone else particularly passionately outside of perverts of all sexes.

Why? Someone telling me I’m not allowed to urinate in the women’s because I look like a man would harass me. If the SP defends the harasser and muscles me out that would further harass me.

And even if the claim didn’t succeed, costs would be unlikely to be awarded. Far more expensive than cleaning.

Women receive medical treatments relating to us being women; doesn’t mean we’re inherently disabled by our sex.

You may think the legal definition of trans is ‘psychologically unable to admit their biological sex’, but that is not wording from the equality act.

That would be a legally incoherent argument, as trans people are protected under an entirely separate characteristic, which the Supreme Court strongly endorsed. It’d be like saying being female is a disability as they tend to be weaker, or being Asian is a disability as they tend to be shorter.

As a gender-non-conforming non-trans woman who is often mistaken for a man, I will immediately sue any service provider that tells me not to use the women’s. The legal costs in defending that will far outweigh paying for extra cleaning time.

And to address those circumstances you need people on hand - and when hundreds use the toilet every minute in the Westfield, that’s a big burden.

Not to mention legal risk. Trying to enforce single sex facilities is far more risky than paying more for cleaning single-occupancy booths.

I never said they were. I said that forcing non-disabled people to use disabled toilets would reduce the frequency of the facility being available for the use of disabled people.

I’m disabled, I’m not questioning the needs of ‘another’, I’m discussing mine.

EHRC doesnt change the law, but they do advise on aspects of it the Supreme Court didn’t address such as practical enforcement.

Disabled people’s rights matter. Able-bodied People should not be forced to take up spaces for disabled people.

Disabled toilets are very rarely single sex in my experience, they’re almost always open to either sex.

I’m sure it does; still vastly cheaper than conducting sex assessments on every user.

It is not reasonable to suppose that a service provider like the Westfield is going to be able to assess sex and enforce the spaces when hundreds use the toilet every minute. Floor to ceiling far more efficient.

Changing the toilets to have floor-to-ceiling walls will be far cheaper than assessing the sex of every adult and child who enters.

No, the SC said discrimination provisions for trans people still stand but reform appear to be ignoring these and suggesting forcing trans people into particular spaces is fine (which is not what the SC said, instead noting the appropriateness of third spaces.

I’m challenging your notion that English people must agree with him of what makes a mother a mother. My wife gave birth to our son, but the egg was mine. No English person has ever said I do not count as my son’s mother, and legally speaking he has two mothers.
