How does an I-9 inspection notice differ from a judicial warrant? - I-9 inspection notices are administrative notices. They do not give DHS any special authority or power to enter non-public areas of a business without the owner’s consent. The Fourth Amendment protects business owners from unlawful searches & seizures. - ICE still needs a judicial warrant to be in non-public areas without the owner’s consent, this is why it is important to put up signs marking private areas of your business. - If your business records, such as I-9 Forms, are kept in a non-public area of your business, the Notice of Inspection does not give ICE the right to enter those areas to access those records. Regardless, you do not have to turn over the records at the time of the initial ICE visit. Do they look different? Yes, they look different. A warrant will include the name of the court from which it was issued and will carry the signature of a judge. An I-9 Notice of Inspection looks like a letter on DHS letterhead, with the signature of a DHS official. Image showing the differences between Judicial and Immigration warrants.
