One thing many prominent attorneys dismiss is the degree to which constitutional law is, well, whatever five votes on the Supreme Court say it is. The only constraint on their behavior is norms. Motivated reasoning can get around any legal roadblock when you’re the final arbiter of what laws mean.
If “major” means something other than “policy choices with which five Justices disagree” then MQD is doctrine all courts, not just SCOTUS, must use to constrain executive actions that exceed the discretion granted by statutes.

The “IF” is real.

But district courts can use this thing in TROs today.
The Court’s beloved Major Questions Doctrine is premised entirely on the idea that presidential policy choices are tightly constrained by the language of federal statutes. If MQD means anything, I don’t see how Trump-Musk’s desire to ignore Congress doesn’t run into it headlong like a woodchipper.

Two weeks after Election Day, and we finally have a result in Alaska’s Ballot Measure 2: voters narrowly (50.1-49.9) elected to keep their open primaries and ranked choice voting system. A big victory for the RCV and open primaries movements.
