Judge Perry says she will issue an oral ruling now and a formal ruling tomorrow.

Perry says the state's temporary restraining order against national guard deployment will be granted, "in part," with a fuller ruling to follow tomorrow.

Perry cites the TRO won against federal agents in Judge Sara Ellis' courtroom this week for 1A and 4A violations, as well as criminal cases recently dismissed against protestors.

These cases "cast significant doubt" on DHS' account of what is happening in Chicago, Perry says.

Acknowledging that vandalism and attacks on ICE agents have likely occurred, Perry still finds that DHS' version of events is "simply unreliable."

Perry:"What troubles me about that reading of the statute is, if the executive branch chose to deploy one ICE agent to the Chicagoland area, and then that person was unable to solve all crime," then that could trigger the National Guard.

Hamilton says that's a "very different situation."

Perry asks again whether, if the inability to execute the law is b/c of the feds' "own provocation, does that matter under the law?"

Hamilton: "No, if that were true, the fact still remains that we are seeing sustained violence against federal personnel and property in Illinois."

Perry: "I am very much struggling to figure out where this would ever stop, because the plaintiffs really believe that it's not going to just stop with that. You haven't told me it's just going to stop with that."

Perry asks, what if the president is relying on "completely invalid evidence?"

"What if DHS folks are not tethered to reality in their assessment of events. Does that matter?"

Hamilton: "A couple points …"

Perry: "You all are reserving the right that they could do all the other things the president has said they'll be able to do. … When I try to nail down with you which specific of those things might still be on the table, you've kind of said, 'Well, I don't know.'"

While they were kept separate from immigration detainees (they described having seen up to 50 people being kept in a dark room together).

The detainee was soaked with water to help clear the pepper spray, but was left wet until release and was refused blankets.

A protester who was detained for about five hours last night tells me they were slapped and called “f****t” (among other names) and were repeatedly slapped inside after being thrown to the ground/maced while being detained.

They say an agent inside mentioned Broadview had deported a citizen.

Protesters yell at one agent with an American flag mask and sleeves “Nazi” as they push demonstrators off the sidewalk in front of the driveway.

“Proud of it,” the agent replied.
