yep, I didn’t know anything about her until she personally killed all the city funding for legal services for low income tenants and turned my job (which was already a shitshow from the cuts to federal funding) into an even bigger shitshow. no. ai is still comically bad when used to substantively draft pleadings. firms have tried it in LA and got sanctioned for it. it frequently invents fake law and is very easy to beat. one good lawyer who understands the intricacies of the practice area at issue is all it takes to expose its flaws

I mean that’s a huge IF but yes, I do agree that you would be safe in the meantime if that happened. I just think the chance of a stay not being issued by SCOTUS is basically nonexistent so I don’t want to give people false hope.

my advice before this admin began was to not under any circumstances give them your documents for any reason. No court opinion is going to make me change my mind tbh. It’s depressing advice to give but I still think it’s important for self-preservation

all of which will take many many year. Basically i don’t see any universe where this gets finally resolved to the stage where a trans person can get a correct passport until after the next election. In which case the case will (hopefully…) become moot if the D’s win

my assumption is that the PI will get appealed to the circuit court, get affirmed, then SCOTUS will grant a stay. Then once there’s a trial, the district court will rule. Then THAT will get appealed to the circuit court, and then SCOTUS will grant cert (if we win) or deny cert (if we lose)

in my opinion yes. I would not advise any trans person to apply for a passport until (1) the supreme court has directly weighed in or (2) an appeals court has affirmed the ruling and the supreme court refuses to overturn it via the shadow docket

it’s almost like there’s already a dozen different laws on the books that can be used to go after sexual predators. Adding one more that only targets trans people does nothing to change that

given the time constraints to get things done before this admin, there’s no wrong decision here and you shouldn’t beat yourself up. Ultimately your passport is still a valid document, is good for 10 years, and as long as the picture looks like you you’re going to be ok to travel.

the advice i’ve given to most people so far is that if your passport is in the correct gender but the wrong name, you should operate on the assumption that the gender will be reverted if you renew under the admin. It’s ultimately up to each person if you care more about the name or the gender marker

presumably if you submitted an SS-5 to change your gender Social Security would have a record of it. I just have no idea if the State Dept would look to outside info.

I think it might depend on what supporting documents you submitted with your first application and what your deadname was. For example, if you submitted a birth certificate with a highly gendered deadname, it could raise suspicions.

that’s a great question that we don’t have an answer to yet. Presumably your info won’t be in PRISM. The question will be if they cross reference with Social Security, which as far as I’m aware we don’t know yet
