Under the Act, an arrest by law enforcement does not need to be lawful to trigger automatic, mandatory detention. Law enforcement will realize that quickly, and use it to their advantage.

There are no protections for young children brought here as babies.

The Laken Riley Act will require mandatory detention for anyone in the country “unlawfully” who is arrested for shoplifting.
It only requires an arrest - not a criminal charge or conviction.
