@foaylward It's a interesting philosophical question of what it means for an intersubjective construct like "checks and balances" to exist if it isn't being used!

@foaylward The system certainly is working well for the oligarchs, though I suspect that when Noah Feldman and my other law colleagues say this, they aren't about it in those terms explicitly.

2) None of these commentaries (that I've seen) address the multiple instances in which a court has stepped in and the administration has defied their orders. (Like the order to resume NIH funding.)

MAGA is widely broadcasting their willingness and desire to defy court orders.

1) This is like saying a bank getting robbed is "the system working" because now law enforcement has the opportunity to step in and investigate and prosecute the robbers.

Crimes are a problem on their own, even if there is still a chance they will be addressed.

University-mediated PhD training is a subsidy for industry (and the capital class). If this is not viewed as a public good, and supported via the federal government, then there is no reason universities should be the subsidizers. Let the companies bear the cost. 2/2
