In August, we dug into all the ways the DOJ guidance does *not* stick to the current state of the law, so I am at least relieved to see that caveat in the settlement.

One thing worth noting is there's a welcome caveat in the settlement's provision about applying the DOJ's (mis)guidance: "...so long as that Guidance remains in force and to the extent consistent with relevant judicial decisions."

Important update, after reading the actual settlement terms: the agreement to follow the DOJ guidance includes the following KEY caveat: "so long as that Guidance remains in force and to the extent consistent with relevant judicial decisions." #phew.

In August we unpacked the DOJ guidance UVA apparently has agreed to be "bound" by (even though it's explicitly non-binding guidance). The misstatements and overreaches were bad enough that we titled our analysis "Misguidance"...

Important story but make sure to read to 10th paragraph to learn that the policy has been *stopped* for now by a federal court for likely violating the law—and the ruling applies nationwide. All eligible Head Start students are still eligible.
