Critical theorists have long emphasized that the law is political & indeterminate, and that legal precedent does not guarantee any one outcome, contrary to the prevailing belief that our institutions abide by “the rule of law”

Yet what we are witnessing unfold is no less terrifying or worrisome
This will have to count as my Supreme Court term review.

I make that point that there's no point in reviewing what the Supreme Court has done because the rule of law is dead in this country anyway.

Key takeaways: (1) deploying the National Guard outside of extremely limited contexts is an abuse of presidential authority and wrongly invades state policing authority, and (2) based on the administration's own memo, this type of deployment could soon be happening in cities across the country

When President Johnson activated the Nat'l Guard in Alabama in 1965 over Gov. Wallace's objection he did it to protect protesters advocating for voting rights for Black people who had previously met violence at the hands of state troopers. Very different situation.

That Democrats, even now, insist on focusing on and blaming the progressive wing of their party for Trump is exactly how we entered the Nadir a century ago. White Americans and those who wanted to politically ascend abandoned Black people and oppressed groups to reunite politically with each other.

(1) Private companies are drawing tremendous profits as #immigrant communities are targeted by the state, (2) local law enforcement are aiding the fed. gov't in its attacks on these communities, (3) detention & collaboration will both expand if fed. legislation passes

Private prisons and local jails are ramping up as ICE detention exceeds capacity
The number of people in ICE detention has grown, and detention facilities are over capacity. So the government is intensifying its hunt for more space, and local police are playing a bigger role.

Today's attacks on #HigherEd are distinct from past attacks for two reasons: (1) rather than target individual professors, today we see attacks on every aspect of universities, and (2) today the academy is in a weaker position to resist political intervention

The target then was the nonexistent threat of Communist teachers; today, it’s the supposed radicalism of the academy and its alleged failure to fight antisemitism.
