Mamdani has a trust problem with a (primarily older) segment of the city’s Jewish population that I think will mostly heal over time as he governs like an ordinary mayor and the fear abates, and the Israeli government gets worse.

Tisch is not an abolitionist and you will never get one to be PD Commissioner. But she is a reformer and does not do crimes, and I expect she will have more success under Mamdani than under crimes mayor.

Right. I'm wondering whether the presentment of an indictment never reviewed by the GJ is one of those issues where the "grand jury have been so compromised as to render the proceedings fundamentally unfair, allowing the presumption of prejudice," like GJ racial discrimination.

I don’t do criminal at all much less federal. It does seem like harmless error to me. But is that the right standard? Could an indictment not reviewed by the full GJ like here be structural error?

The recodification of state law issue in our Charter is really dumb and should be addressed. It is bad that some provisions of the Charter are secretly - yes, secretly - not amendable through the ordinary Charter revision process. It also makes statutory research very hard and I hate it.

On 2nd thought it may require an act of the legislature, since the charter/admin code provisions empowering the commissioner with disciplinary authority are recodifications of state statutes. A council charter revision commission would probably be preempted but a state created commission would not.

Ideal way to have that fight would have the council establish a charter revision commission and make that proposal to switch final authority for police discipline to CCRB. Police unions mad either way but Council could take the heat better than Mamdani or Tisch

A permanently empowered CCRB would require a Charter amendment I think, so it’d only be temporary anyway. Might be worth having that fight at a later date but not right now
