Problem is if you treat visa overstays in the same manner as parking tickets, there would be no incentive for anyone to obey immigration law. Penalties have to be tougher. Most countries look to deport those who violate immigration law.

Ed is a complete hypocrite on this.
Whenever Ed Davey & the Lib Dems advocate a customs union with the rest of Europe he should be reminded that if he hadn’t whipped his MPs to vote against Ken Clarke’s #Brexit amendment in 2019, we might have got one.

You made the bold claim re a "shining hill". I and others challenged it.

It's factually not as simple as "every EU citizen can now marry and live an unhindered family life anywhere in the EU." Perhaps one day, but not now.

Meanwhile, even the US has managed to be more progressive in this respect.

She didn't have a green card in the first place. She entered under ESTA and tried to stay in the US while her IR1 was processing. She should have used the K1 route.

Another issue is that ESTA isn't a visa, so she wasn't adjusting from one visa to another. She should have left and awaited IR1.

The article appears wrong on this point:

You can adjust status from one visa to another but ESTA isnt a visa, so she had to leave after 90 days and await IR1 processing

I (and others) point out that what it's actually doing here is limited. The EU has failed to force through equal marriage across the EU. The US has done that. The UK has done that.

Not the EU.

Yes its toothless. The CJEU can rebuke a Member State for non compliance, and if that doesn't work, the Commission can refer it back to the CJEU re financial sanctions. However, the Commission itself has to do that, with the Commission being made up of Member States who prohibit equal marriage.

Not in the context of what people voted on in 2016, no. There were 17.4m individual reasons for the Leave vote.

By your apparent logic, 9 million Swiss are deranged nationalists for not wanting to be in the EU. You may think that, I don't know, but it isn't true.

Interesting points. I don't know what power the UK has to legislate over those territories, given their degrees of independence. Bermuda, which I'm familiar with, did allow equal marriage for a while but then appealed it.

This is you, saying the EU is the world's best example of freedom and tolerance for ruling on this issue. I pointed out the US and UK already allow equal marriage across their territories (since 2015 and 2014 respectively).

It is almost 2026, and the EU still does not. So no, it isnt what you say.
