the answer to your question is that treaties were made over the past century under different (or willfully ignorant of) hydrological conditions. And modern management should take the climate/hydrological realities into account!

I have met quite a few people who don't realize that most aquifers aren't larger cavities--like flooded caves--in rocks. Luckily not any who *actually* believe the convenient legal fiction that surface & groundwater are separate, but I'll bet there's someone.
