Parliament should have the ability to set strong minimums for the most serious offences, as long as the legislation is carefully targeted and still allows for discretionary relief in these specific types of low-gravity cases.

The Court is right that judges must retain discretion in order to avoid grossly disproportionate sentences - that is evident.

But the Court is too restrictive of Parliament’s role —
