Amazing round-up of arguments in the tariffs case by Harold Koh and his students published by @justsecurity.org. www.justsecurity.org/123818/scotu... I think the anti-tariffs side has the much stronger argument.

I spoke with Bloomberg on the oddity of Trump pushing tariffs on goods, while insisting on no tariffs on digital imports. "Trump Pushes for a US-Led Digital Economy That’s Free of Tariffs" -- www.bloomberg.com/news/article...

If Pres. Trump is relying on IEEPA for the movie tariffs, he will likely find that he is blocked by the Berman Amendment.

Pointed out to the @washingtonpost that the Trump Admin's influence over who controls TikTok is highly unusual even considering the executive's role in supervising national security mitigation agreements. www.washingtonpost.com/politics/202...

Told Newsweek that $14 billion valuation for TikTok U.S. was a "fire sale" price (even if, by the way, ByteDance retains 50% of profit).

Here's what the Congressman who wrote the TikTok law said in January 2025 about the law: "Congress Didn't Ban TikTok."

The problem was that Congress insisted that the law wasn't a ban--even though that is, as you say, what the law actually said.

So much crazy in this. The South Korean gov't had to insist that the workers not be handcuffed as they were led to the flight--but Trump said that they could stay (presumably not handcuffed) in the U.S. to train Americans. One of 331 chose to stay. www.ft.com/content/fdbe...

If the "US paid nothing" for Intel's shares, does this mean that the U.S. government extorted them?

Nice @zey.bsky.social piece about deepfakes, warning about putting governments in charge to weed out "fake" news. She describes proposal by Sen. Klobuchar to permit Health secretary to designate health misinfo that would be excluded from 230 liability protection. www.nytimes.com/2025/08/11/o...

This claim, that China won't let foreigners acquire algorithm, seems to be disputed by (1) Trump Admin; and (2) reporting. TikTok US sale would be part of China-US trade deal. 3/

Argues that the Biden Admin abandoned Project Texas in part because they didn't want Republicans to accuse them of accommodating China. Both parties passed the divest-or-ban law in 2024 because "no party wanted to look weak on China." 2/

More on the TikTok ban, now via Glenn Gerstell, former general counsel of the NSA (during Obama II and then Trump I--2015-2020) (now at CSIS and teaching adjunct at Georgetown Law). Obviously someone with a lot of knowledge on the issue. 1/

Japan just made everyone else's job negotiating with Trump much, much harder: Japan is giving Trump the ability to direct a $500 billion investment fund and keep 90% of the profits for the U.S.
Japan just handed Trump a sovereign wealth fund and enormous power over the economy.

Trump keeps on threatening ruinous tariffs even on countries that run a trade deficit with us. Earlier Brazil. Now Kazakhstan. There is no logic here, just pure power politics. Not a way to win any country to our side.

Imagine if after a terrorist attack, the headlines read, "Some Americans fear attack while getting aid" and no summary headline for those days says "Some Americans killed while trying to eat"
Also "getting aid" is a heck of a euphemism for "trying not to starve" -- www.nytimes.com/column/the-h...
