Dunn’s lawyers have claimed the case is “selective and vindictive prosecution,” arguing he was singled out for prosecution “not because of the nature of his alleged conduct — throwing a soft object that caused no injury — but because his outspoken, viral critique of the current administration’s policing and immigration policies made him a political target.” Federal prosecutors opposed Dunn’s lawyers’ motion to dismiss the charge, writing that Dunn was “recorded throwing a sandwich at a federal officer [highlighted text] at point-blank range [end of highlighted text].”

Tonight is the fifth annual Jammin’ for Justice benefit concert in #Somerville, which raises money to send #Massachusetts exonerees to the Innocence Network Conference in Chicago.

Some of the musicians are exonerees or lawyers for exonerees.

We threw ourselves to the ground and stayed there until the shooting stopped. I couldn’t reach my house. “It feels like the war hasn’t really ended for me. What’s the point of a ceasefire if I still can’t return home?” He added: “It breaks my heart to see people on my way going back to their houses while I remain stuck between hope and fear. But what worries me most is the idea that this line might stay, that no decision will ever allow us to return.”

A Boston federal judge today ordered the immediate release of an Ecuadorean national living in Framingham who was detained by the Border Patrol in Maine on May 14, handed over to ICE, shipped to Youngstown, OH, ordered released on July 1 on payment of a $15,000 bond, grabbed by Homeland Security in New Hampshire on July 25, shipped down to the Plymouth County jail and ordered released again by an immigration judge in Chelmsford on Aug. 4, on just $1,500 bond. Only this time ICE refused to let him out as it appealed his bond to the Board of Immigration Appeals in Falls Church, VA. In a ruling this afternoon, US District Court Judge Indira Talwani said enough.

Speaking of how great cops are, check out this wrongful conviction story I just published.
However, in a motion filed in March 2024, McGee’s lawyers said that newly disclosed evidence the prosecution failed to turn over before the trial casts further doubt on the testimony of one of the witnesses. And in October, after conducting a new investigation, the district attorney’s office filed a motion that—while not explicitly describing McGee as innocent—says that there was “a substantial risk of a miscarriage of justice” in the case. The evidence, according to the district attorney’s office, shows that the witness admitted to threatening McGee’s family and collecting a $25,000 reward for her testimony. It also shows that Boston police officers protected her from prosecution for alleged bank fraud, even threatening to arrest the victim, the district attorney’s office said.

This program increases the risk of police violence and will cost more than it saves.
After a written warning, riders are issued $50 civil citations at each of their next three offenses. Only on their fourth or subsequent violations will riders be fined $100. Uncooperative riders who refuse to provide identification or contact information are asked to leave the station. Staff are instructed to contact superiors and the MBTA Transit Police if the person does not comply. Through Monday, no such situations had occurred.

MassLive just published an article about a new MBTA crackdown on fare evasion. During a month and a half, they gave out 85 warnings. Those fares add to... $204.

Does that justify a whole program that costs who knows how much?
Six weeks into its increased crackdown on fare evasion, the MBTA has issued dozens of warnings but not yet any monetary fines to riders caught dodging fare gates. Under a new system rolled out in September, the T will afford each rider one warning before staff begin doling out citations. The agency’s “fare engagement representatives” issued 85 warnings from the program beginning on Sept. 8 through this Monday, according to MBTA data. If any of those riders are caught again, fines will start at $50 and eventually climb to $100.

There's some really egregious stuff in this report about the new #Massachusetts police academy.
Former Academy Director Donelan sought to give the class a “shock and awe experience”, according to the report. It says: punitive training was routinely used for punishment and discipline, forcing student officers to engage in activities that had “no training purpose or nexus to the job of a police officer”. Recruits faced forced exposure when they were made to dump 32-ounce water bottles over themselves while exercising in below-freezing temperatures, and were made to perform excessive PT outside in the cold without proper attire. One Sergeant pushed recruits’ faces into the mud and ice with their boots to force them lower while crawling up a hill, with one recruit reporting injury to his eye after being pushed into the ground. Recruits were also “denied adequate bathroom breaks”. The report notes that one break was so short that two of the eleven female student officers in the class “had to urinate in the shower stalls.” Recruits were subjected to humiliation when, during a bag inspection, a female recruit’s underwear was taken out of her bag and thrown on the parade deck. Instructors were reported to have made comments about the “nature and style of the underwear to the entire class”. Recruits sustained multiple injuries, including severe bruising and sprains. Two student officers were transported to the hospital—one for a laceration and sprain after falling on the icy hill, and another for dehydration and exhaustion. The MPTC was “not notified of any of these injuries” or the hospitalizations, in violation of policy.

Meta’s Ray-Ban glasses are the tech giant’s main attempt at bringing augmented reality to the masses. The glasses can take photos, record videos, and may soon use facial recognition to identify people. Meta’s glasses come with a bright LED light that illuminates whenever someone hits record. The idea is to discourage stalkers, weirdos, or just anyone from filming people without their consent. Or at least warn people nearby that they are. I told the Justice Department that my deadline was 4:15 p.m. In response, the department sent the statement quoted at the outset of this piece. In addition, just a few minutes before the deadline, my dormant Signal connection with Halligan suddenly came alive again. At 4:10 p.m., she texted me: “By the way—everything I ever sent you is off record. You’re not a journalist so it’s weird saying that but just letting you know.”

Once arrested, Everett police recovered a “six-to-seven inch double-sided knife,” he said. But DeMaria also said no firearm was recovered at the scene, which contradicted the claims of a Trump administration official. Tricia McLaughlin, a senior U.S. Department of Homeland Security official, posted on X Monday that the teen had a gun when he was arrested and “an extensive rap sheet.”
