So basically DOJ was flagrantly violating the court’s order, as Sotomayor notes (her dissent was before this came out), but this is even worse: It’s a coordinated effort by top DOJ leadership to ignore court order; to mislead lower court in filings; to deflect on another agency; then to cover it up.

But there’s more: WB realizes that language had been inserted into their filings to create plausible deniability, AND they were trying to cover tracks after by stopping any paper trails after 4/

WB tells us what was going on on the other side: DOJ “leadership” had stopped DHS lawyers from disseminating guidance to ICE agents on what they needed to do to remain in compliance with the injunction, and had no plans to do so 3/

Sotomayor’s dissent is flabbergasted that the government had been blatantly violating the court’s order up until that point, and then had been misrepresenting to the court who was responsible for it (saying it was DOD, not DHS) 2/
