From the argument at the end of the thread, he wants to raise an advice of counsel defense. I frankly haven’t followed the trial closely enough to know if that’s legit here, but the judge sounds inclined to not allow it.

Old man Posner who just didn’t give a fuck anymore was best. Experienced judges know they can mostly do whatever they want. (Aside: Modern appellate opinions are just obnoxiously long. You can tell that they are mostly written by people who have never practiced law for a day in their lives.)
