Noah Feldman is a true minister-without-portfolio when it comes to rank incompetence about the law and legal institutions. See, e.g., his blithe assertion that corporations owe fiduciary duties to shareholders (they don't, how would that even work, etc.).

A lovely piece, but because I'm insufferable I have to note that the "subject to jurisdiction" question was asked and answered in Plyler v. Doe.

Also, the dual citizenship question cuts *against* the asinine allegiance claims, because w/ dual citizens the US recognizes only the US citizenship.

I know it's not central to the point, but Plyler v. Doe did, in fact, address this question. While I get that the professors in question are trying to put ye olde lipstick on a pig to prove that SCOTUS and everyone else has been secretly wrong this whole time, memory-holing Plyler does annoy me.
