The argument that 504 itself is unconstitutional and should be thrown out isn't even mentioned until you're 37 pages deep in the 46 page complaint. It's buried on purpose - a common legal narrative strategy to lure the audience in and once they're on your side, drop in the more controversial stuff.

It feels like they're relying on the hatred of trans folks to win them the day, because just going after Section 504 might not be popular enough with the court. But tie it to a group disfavored in the Fifth Circuit and you're off to the races. This is why our liberation will always be intertwined.

i can't emphasize enough the role that transphobia plays in Texas v Becerra. The states get their foot in the door by arguing that they intend to keep discriminating against trans folks and it's unfair to punish them for doing so. And then use that to undermine ALL of Section 504.

That’s it. That’s the messaging. Don’t get bogged down disputing Trump’s false claims. Just blame him, in short and repeatable sentences.
