“Open investigations” do not exclude “suspects“ based on party affiliation.
There is more to this than the obvious corruption. I suspect it is the latest attempt to withhold the incriminating Epstein files. If DOJ has an open, ongoing investigation into Epstein again, it can use that fact as a pretext for withholding any documents, lest it undermine the case. So shady.
