No. That is fear, not facts.

There is no evidence that trans inclusion destroys sport. That is why rules are sport specific, not blanket bans.

Interesting piece.
The points about human rights/EU law have force. But for me, the central problem with the FWS judgment is more fundamental. It strikes me as implausible that this is what Parliament intended, without spelling it out, only 6 years after the GRA, and in an Act dealing with equality.
So much of the commentary on the FWS judgment has been driven by reflexive responses to the outcome, but there are so many gaps and leaps in its reasoning that it will spawn litigation for years to come - @aoifemod.bsky.social and I flag some failings in judge craft:

Inclusion is lawful. Exclusion is not mandatory.

Kelly v Leonardo is one of the first post-FWS workplace-facility cases - and Tribunal held that allowing toilet access based on asserted gender identity can be a proportionate, lawful policy.

THE PEGGIE JUDGMENT IS OUT + THE RESULT IS NOT HOW MEDIA IS PRESENTING IT

This case doesn’t say employers can’t allow trans women to use women’s changing rooms.

Quite the opposite: FWS doesn’t make that inherently unlawful. It all depends on context.

Here I consider whether with trans claimants we can use ‘intolerance’ as something that sits next to hatred/violence, as a way of making speech or belief against trans people fall into Article 17 Convention. The ECtHR case of Ibragimov would support this.

This directly contradicts the Supreme Court’s position that gender reassignment does not change sex. For the purposes of equality, it does.

Here I explain why non-binary is protected under ‘gender reassignment’ discrimination, though the Supreme Court did not clarify this protection.

NB: still no intersex protection in UK law which is unforgivable.
