Point worth reiterating: “ICE officials have told us that an apparent biometric match by Mobile Fortify is a ‘definitive’ determination of a person’s status and that an ICE officer may ignore evidence of American citizenship—including a birth certificate—if the app says the person is an alien."
DHS document states ICE will NOT let people decline from being scanned by its new facial recognition app - Mobile Fortify.

It is used to verify one’s identity and immigration status. However, the face photos taken will be stored for 15 years, regardless of your immigration status.
