Chief Justice Roberts has lamented the Lochner era over the years. It appears he lamented they did not go far enough. Hopefully history will be equally unkind to the Roberts’ court.

During law school, a student had a schizophrenic break and several committed suicide. More suffered significant mental health challenges. More than a decade later, a student in my first class took his own life. We have to do better. I became a law professor to do better. The law must do better.

A priority is to send a message to an already marginalized group that they will not be recognized or valued? The very issue that leads to outsized bullying, assault, suicide, substance misuse, self harm, alienation, and discrimination? I am glad we are coming together as a nation.

In 1977 the NY Supreme Court held that Renee Richards could compete in the US Open as a woman stating, “the unfounded fears and misconceptions of defendants must give way to the overwhelming medical evidence that this person is now female.” More than 45 years later people still don’t get it.
