Yes, a whole new area of discrimination has been born born. Indirect disability discrimination by association will be tested next year and that is even more mind blowing.
Not unexpected but could have huge consequences. I must admit I find it hard to wrap my head around right now given that it seems to run counter to a strict reading of s19(1) “…a provision, criterion or practice which is discriminatory in relation to a relevant protected characteristic of B's”.

Here is the legal explanation for this important judgment on extending indirect discrimination claims to persons who do not share the protected characteristic but suffer the same disadvantage—a first in UK law.

🗣️ We have just received judgment. The President of the EAT has dismissed British Airways appeal against the Tribunal's decision to allow former BA cabin crew to bring extended indirect discrimination claims because she said these claims are consistent with Equality Act protection.
