Yup.
Roberts court will live in greater shame than Roger Taney/'Dred Scott' court. If there are historians around to write such things.
I hear that Roberts's greatest fear is a 'confrontation' with exec power. He solves that by endlessly giving in. 'Obeying in advance' = the Roberts legacy.

They could have done something like this in the Trump immunity case and given a chance for the special counsel to take Trump's federal election subversion charges to trial.
