Dad, husband, appellate advocate, legal writing, oral advocacy, autism dad. Comments worth what you’re paying for them. Comments are mine, not my firm’s or its clients’.
Just so long as you didn’t say, “Hey, what a dish.”

I’ve argued that the timely filing of a notice of appeal is an event of jurisdictional significance, but Beth has countered that it’s merely a claim-processing rule in this case.

Thirty-seven years ago today, I asked Beth to let me be her husband. She said “yes.” Asked recently about that decision, she suggested that it might have been an abuse of discretion. I may yet be reversed and remanded.

Maybe you can make the cover of “Rolling Stone.”

They do make themselves heard, eh? I’m so sorry. I hope the nice hospital folks have given you pain medicine.

This is a particularly nice painting, Lori. Best wishes for a happy new year.

Today, I offer a pat on the back to the folks who designed the Miami International Airport. We spent yesterday in the terminal waiting for a flight to Baltimore after a short cruise to The Bahamas. (You may recall that our son is an adult with autism, his dad's best pal, and an ardent beach boy. 1/

Did we need to ride the escalators up and down? Again, no. Did doing those things beat just sitting at the gate? You bet.

I'm guessing the folks who designed the escalators and SkyTrain weren't thinking about entertaining my boy, but they did. And my wife and I are grateful. 3/

With delays for weather and what not, we spent about eight hours in the airport. May I note that the escalators and the SkyTrain in the MIA provided us with hours of fun? Did we need to ride the SkyTrain from one end of the airport to the other and back more than once? No. 2/

Sat next to the Snackwells Cookie lady (“Hey, Cookie Man…”) at Sardi’s. She was lovely.

I’m so sorry. I’m prone to them, so I empathize. I hope you have good pain relief.

I’m so terribly sorry, Raffi. A remarkable man. May his memory be a blessing.

Sign of the times. Used to see Bill, a lawyer a few years my senior, at bar association gatherings. Saw him yesterday at physical therapy where, instead of discussing the latest from the Supreme Court, we shared stories of our bad backs. And so it goes.

Ironic, no, that the Oxford University Press will enrage thousands by declaring the two-word phrase “rage bait” the 2025 “word of the year”? And not that Alanis Morissette kind of irony.
The phrase “rage bait,” Oxford University Press's word of the year for 2025, refers to online content that is “deliberately designed to elicit anger or outrage by being frustrating, provocative or offensive.” https://wapo.st/3KBpKTH
