We still don't know the details here. But journalists should know the questions that must be asked to determine if this was an ICE-provoked death. When ICE pulls over a nonviolent offender, their job if the person flees is to use their plate to go to their home—not start a chase.

If what we see online of Trump voters is any indication, a large percentage of MAGAs don't actually know how to live in a human society. They have ideas about how to think through crises—or try to, as they usually can't—that are profoundly antisocial and dangerous. So stay alert.

In law school, one of the first things you learn in Torts class is the idea of "the bearer of least burden." A society wants the bearer of least burden to engage in due care to avoid catastrophes. The bearer of least burden is usually a repeat player in a system.

I understand MAGAs have no interest in how laws work until they affect them, but the rest of us do: we need to know if ICE engaged in a pursuit, and if so whether this man was wanted for a status offense or serious crime.

ICE has regs on vehicular pursuit for this very reason: because a nonviolent person with little criminal justice interaction is likely to be so terrified if chased they'll endanger the community by accident.

If ICE knew this was a status offense, there should have been no chase.
