The DOJ has the power to choose which cases to prosecute, and judges should be cautious about challenging these decisions to preserve the separation of powers.
U. S. District Court Judge Dale Ho will hold a hearing tomorrow on whether dropping the federal prosecution of NYC’s corrupt mayor is in the “public interest.” It isn’t. Deference to DOJ is required. Abdication of judgment isn’t. If ever there was a case in which the judge should say no, it’s this.
