imagine someone says your toothpaste is deceptively marketed. says “all natural.” someone buys a tube for $8 and sues seeking an injunction. do you pull all of your toothpaste off the market to relabel it or do you pay them (really the plaintiffs’ firm that recruited them) $15,000?

the consumer or employee just needs to seek injunctive relief and suddenly the arbitration becomes must-win, and even if you do win another plaintiff can just try again. over and over. you have to pay them to go away and the amount you pay is orders of magnitude larger than the claim

let me tell you that another year or two and you might get capital on board with this. arbitration is a complete shitshow and in many cases more expensive than litigation ever was. companies would absolutely rather fight one $200m class action than 1,000,000 $100-$200 arbitrations
