Ce thème de la souillure, désormais épuré de sa dimension religieuse, montre que l’on perçoit différemment les victimes de violences sexuelles à la fin du siècle. Si l’inceste est corruption morale, et donc sociale, sous la plume de l’avocat aixois Portalis, il faut plusieurs décennies avant que son pendant, la souillure, se répande avec une acception laïque. Le poids croissant de la thématique de l’enfant martyr a permis l’émergence de ce corps enfantin. La souillure et la saleté engendrées par l’inceste sont alors comprises non plus seulement sur le plan physique, mais aussi sur le plan moral. L’idée se fait jour dans l’esprit des magistrats que l’enfant est une victime au sens contemporain du terme, c’est-à-dire une personne atteinte dans son intégrité personnelle et physique par les agissements d’autrui. Alain Corbin le remarque à juste titre : dans les dernières décennies du siècle, « on évoque désormais, d’une manière ascendante, le dommage intérieur, le saccage intime, l’intégrité bafouée, l’identité compromise ». Mais l’émergence de cette notion de souillure a également un effet pervers qu’on ne saurait omettre. D’une part, l’apparition de la thématique de la souillure dans les actes d’accusation à partir des années 1870 relève encore largement d’une logique rhétorique qui ne signifie pas nécessairement la prise en compte du statut de victime de l’enfant. À la fin du siècle, on cherche encore à protéger la société à travers l’enfant plutôt que l’individu-enfant en soi. D’autre part, on ne saurait manquer de constater que cette thématique de la souillure émerge parallèlement au renouvellement du tabou. Penser la souillure, c’est aussi penser la pollution et, par ce biais, penser la contagion. Les magistrats se montrent donc très vite réceptifs aux discours véhiculés par l’anthropologie qui tendent à penser l’inceste sur ce double mode de la pollution-contamination qui induit la souillure.
