Today's the day! I'm going to take a punt and say this judgment will be a unanimous ruling in favour of the respondents/customers. Big changes coming!
The Supreme Court will hand down its decision at 1635 on Friday after the stockmarket in London has closed. Rare if not unique timing instead of normal 0945. Whichever way it goes it will be huge for the banks involved bit.ly/4kXZVsY

It is important to understand what this case is about, so as to follow why retrospective legislation letting the lenders off the hook is such a bad idea.

Another Paul Baxendale-Walker tax avoidance scheme fails, this time at the Court of Appeal.
Baxendale-Walker's own lawyers were acting for the poor taxpayer, and even they admitted the scheme failed. The only question was how badly it failed. The answer turned out to be: very badly.

In my chapter, Rights of Objects of Powers (forthcoming in the Oxford Handbook of Comparative Trust Laws) I argue we have become sloppy in our analysing powers of appointment. A more exacting analysis not only helps us better understand mere powers but discretionary trusts (trust-powers) also. 1/4
