Shout out to the High Court of Australia for a progressive #NativeTitle decision on connection without presence, and how to prove it: [2025] HCA 12 at paras 24-26, 53-100. Canadian #Aboriginal title was partly built on #Australian law (Delgamuukw at para 153), so here’s hoping Canada follows suit.

Apparently, #California courts have been re-enacting historical civil rights cases since 2023. It’s a great way to make justice more transparent and accessible. Has any Canadian court tried this, @lawscribes.bsky.social?

The Court of Appeal for Ontario just released a fascinating decision, holding that contributory fault is a defence to breach of contract, so damages are apportioned based on relative fault (paras 41-45). It keeps getting harder to cleanly separate contract and tort. www.canlii.org/en/on/onca/d...

Barristers are taught not to wear their #gown outside the courthouse. In Ontario, it’s a faux pas. But in Tanzania, speaking to the press while wearing a gown warrants disbarment: 2024 ONSC 6240 at paras 114-116. I wonder if the same applies to posting pictures of oneself in a gown on #SocialMedia.
