I've just published my thoughts on the NSW Supreme Court's new restrictions on AI use in litigation. The court essentially bans the use of GenAI tools without distinguishing them from public chatbots. It's a step backward when we need to be embracing innovation.

Exciting to see LA Superior Court -- the busiest court in the world, moving forward on using electronic service of documents -- much better than mailing paper around.

Lawyers: Your job is to manage risk, not eliminate it. AI tools bring big risks—and big potential. You can’t afford to sit this out. You need to learn how to use these tools responsibly *and* advise clients navigating their own AI risks. Staying still isn’t safe; it’s falling behind.

Up to now I have seen roughly 1000000 overconfident predictions of what "China" is going to do about AI and roughly 0 discussions of how AI in China is regulated. Super helpful discussion from Russ Wilcox.
Here's how China is regulating genAI.

- models facing public must register
- security check by both provincial and central government
- AI's opinions must "uphold core socialist values" (see pics)
- licenses monitored

190 models registered by August 2024.

Sounding the #lawlibrarians klaxon. There's so much law librarian scholarship about what neutral citations could enable, but I'm particularly fond (as a citator nerd) of this piece by Andrew Martineau: Garbage in, Garbage out: Improving Citators through Improved Citations (available on Hein)

Me: within 5 years will we see AI reviewing instant replay in NFL and NBA?
My friend the sports fan: No way. Fans are going to reject turning that over to a machine. Also, the leagues LIKE IT when fans spend all week arguing about controversial calls.

When law firms and legal tech vendors say, "We want to train AI on your documents," they may mean (1) retraining from scratch, (2) fine-tuning (aka modifying) the model, or (3) RAG (adding data without changing the model).

1) Use of AI in court is disrupting an uneasy balance: In the U.S. courts (as opposed to, e.g. courts in France or Germany) effectively outsource a lot of legal research to attorneys, and the courts rely on opposing counsel to keep each other in check.
