Enjoyed discussing redistricting wars, voting rights, and communities of interest today at Widener Delaware Law School. As a redistricting nerd, I was energized but the legal audience found the relative lack of national guardrails normatively depressing.

Technically Davis v. Bandemer (1986) said partisan gerrymandering was justiciable, and then Rucho (2019) strongly disagreed and overturned. But in practice, both cases affirmed and kept in place partisan gerrymandered maps.

The R gerrymander in 1980s Indiana worked as expected in the aggregate, but some R incumbents lost unexpectedly along the way to the gerrymander. In Davis v. Bandemer (1986), SCOTUS allowed partisan gerrymandering and it was affirmed again in Rucho (2019).

As Indiana is pressured to redistrict by White House, state legislators may recall Davis v. Bandemer (1986). Rs gerrymandered legislature in 1980s but in several seats Dems surprisingly won later due to Rs spreading out R voters across many districts. supreme.justia.com/cases/federa...
