It's very funny for Schumer to try this penny-ante three-card monte routine on BlueSky, the world's largest gathering of Senate procedure sickos

I don’t say things like this about judges often, but if you’re criticizing KBJ on appellate procedure, you better have some kind of qualifications beyond just being a poster
If you can’t count to five, please don’t jump into my replies telling me how you could have handled this better than Justice Jackson.

this is excellent three-dimensional chess. every good politician knows that the average person loves it when you openly care more about senate procedure than their lives.

But at some point, if following the law and procedure leads to this, what's the point of following the law and procedure?

Conservative SCOTUS justices do whatever they want, law and procedure be damned. Law and procedure are means to an end, not an end in themselves.

This was not a surprise to anyone who followed me and other actual reporters who know Supreme Court procedure.

The only places it succeeded were to generate donations for Liberty Counsel and to prompt clicks through ragebait headlines from your favorite resistance grifters.

Sorry, it's true.
BREAKING: The Supreme Court DENIES former county clerk Kim Davis's request for the justices to take up her longshot bid to overturn 2015's Obergefell v. Hodges marriage equality decision. No justice even writes about the request.

And yes, I'm still jacked that the Senate thought it was more important to protect the filibuster than to protect American healthcare. But honestly, that's far from the most egregious and durable sin committed in the name of Senate procedure. www.commonwealthfund.org/publications...

If institutions and procedures cannot help human beings, they should be ignored or abolished. No institution or procedure should be defended for its own sake.

"For procedural reasons Justice Jackson had to issue the stay, I'm sure her legal reasoning was sound...."

PEOPLE. ARE. STARVING. Can they eat the rules of procedure? No? THEN FEED THEM.

The purpose of a system is what it does. And if the rules of procedure allow people to starve, they're wrong.

This, from @americalabs.org (one of the smartest people abt leg procedure), counters what a lot of people are claiming about this cave. But the follow-on adds to what I noted abt setting up opportunities in January.
5) Dems showed (a) it's possible to get something out of "shutting down the government" despite what the pundits said, and (b) that they could hold together for 40 days. It's not a policy win, but it changes expectations for what they can do in the future, strengthening their negotiating position.

Or, as I said before, you can't eat the rules of civil procedure.
However, I think the liberal Justices are disgusted by the conservative justices open conservative bias but still are unwilling to become activists themselves in response. The same reason they are disgusted with the conservative justices is the same reason they’d never break the rules themselves.
