Working on Nexus A handful of countries like India, Nigeria, and Colombia currently maintain significant economic presence (SEP) taxes, but these rules, which determine a taxable nexus based on an entity’s economic activity and market engagement rather than physical presence, have run into some challenges. In a comment letter, the South Centre suggested that the U.N. Tax Committee provide some guidance in its model tax convention on how countries can implement such taxes: These continue to run into barriers in the case of tax treaties that do not have an equivalent provision and hence override domestic law through their outdated requirement of physical presence-based nexus. Guidance by the UNTC on such new nexus rules which do not require physical presence will be helpful for other SC Members and other developing countries to undertake similar measures and to renegotiate their existing tax treaties by inserting the provision. Relatedly, the South Centre mentioned that profit attribution is an issue for some countries with SEP rules. It believes the U.N. Tax Committee can assist by considering a general formulaic apportionment method that builds on work already done by the committee in articles 12AA and 12B, as well as the OECD’s amount A of pillar 1 and undertaxed profits rule of pillar 2. Similarly, the BEPS Monitoring Group urged the committee to work on new profit attribution methods that do not hinge on physical presence. Notably, article 5.3.b of the U.N. model tax convention allows for a permanent establishment based on the provision of services, and the organization believes there is scope to work on related profit attribution rules. “The UN Convention still includes article 7(4) which allows for attribution to a PE based on apportionment, and this could be clarified and if necessary extended,” the organization commented.
