今回の英での画像素材サイト米Getty社による英StabilityAI社に対する訴訟では、判決文の結論で「要するに、Gettyイメージズ社は商標権侵害の申し立てで（部分的に）成功した」とあり、部分勝訴とも言える内容ですね。

＂生成AIが商標のウォーターマークを再現した場合、生成AI企業による商標権侵害となる＂と判決したことは画期的ですが、
他方で、AI学習が米で行われたためAI学習については管轄外とした上で（注：英は域外適用を定めるEU AI法を批准せず、被害者の住所地も米国）、
米でAI学習した生成AIモデルを輸入してサイト上で配布した行為の著作権侵害は認めないとしたことは、残念でしたね。
