It's a bit 1970's like the "token black" on television. I know trans are thin on the ground but the lack of trans people at senior level and public facing roles by default is noticeable. PSED has done fuck all and shit NHS trans healthcare means we never get past the job interview.

Really important High Court decision today, quashing a local authority’s council tax reduction scheme. The judgment contains many lessons about these schemes. Trafford's scheme was ultra vires, irrational, and unlawfully discriminatory, and breached the PSED @rightsnet.org.uk @nawra.bsky.social

Shes admitting they havent, and cant be bothered, to do that, a clear example of failing PSED.

Shes also admitting that the exclusionary legal landscape the EHRC helped engineer is completely unworkable, which should be grounds on its own for Labour to throw the code out.

They wont tho.

Suggestion for any parliamentarians who see this. Put down a PQ to the Cabinet Office to ask them if an assessment has been made of whether use of X is compatible with GCS propriety rules, the Civil Service Code and the PSED. And if not, why not.

Making this all about X The Everything App as the core issue - and not about the actions of British politicians and media outlets - is a helpful way of externalising the problem away from e.g. journalists who spent years writing migrant-terror articles for the Express. Like Gabriel did, for example.

There's some real underlying issues here - like bad research questions, unclear data publishing, & people misunderstanding how GDPR supports collecting data on protected characteristics for research purposes into issues like PSED - but by veering outside its scope the report lets those issues down

p.78 of the ruling is the EHRC lobbying the Supreme Court to remove the rights of transgender women. In this part of the ruling, recommendation no.3 calls on transgender women to be banned from book clubs. How is this proportional? How does lobbying to remove rights sit with PSED? a book club!

I would hope her MP and police are already preemptively involved. PSED and Prevent Duty applies to police as does a duty not just to detect but prevent crime.

Any chance the case can be halted and a separate action taken against her for harassment or public menace etc if she is abusive in court?

I'm so glad we got these high courts to interpret these complicated words like legal requirement and that they actually mean nothing.

"The public sector equality duty (PSED) is a legal requirement for public authorities and organisations carrying out public functions." - shucks, sure seems optional

Read the case I referenced. Your policy shouldn’t lead to unlawful indirect discrimination or breach PSED. No doubt Ealing Council would have said the same as you prior to judgment

Mmm, mostly in the inverse. The police argued the PSED necessitated attendance. The judge said that the police duty of impartiality is an actual binding duty to achieve impartiality, where the PSED is only to have regard for equality, and cannot mandate a result.
