This is something the Canadian PMPRB does and I'm surprised that it hasn't been simply cut-and-pasted into the FDA's operating methods already, along with all of the other stuff the PMPRB does - one of the few elements of so-called "good government" I've ever seen.

New annual report (covering 2023) of Canada's Patented Medicine Prices Review Board #PMPRB is out.
Of note: "The R&D-to-sales ratio was 3.7% in 2023, an increase from 2022". Since 3.7%<10%, it has now been under the industry commitment of 10% for the past 23 years. 💊💰 www.canada.ca/content/dam/...

Buried in an Annex to yesterday's federal budget was a very curious statement about the #PMPRB, Canada's drug pricing regulator.

In order to cut costs by 15% (as almost all federal agencies have been mandated to do), the Board would 'modernise its hearings':

Or you could just review and respond to price gouging through regulation:

[In Canada]...under the Patent Act.... mandated to protect the interests of ... consumers by ensuring that the prices of patented medicines... are not excessive. ...PMPRB can order price reductions offset of excess revenues.

The only thing is that the PMPRB hasn't had a hearing in quite some time. And if you go to their site, you'll see there are 'no matters' pending before the Board:

It sounds like a good idea, right?

Unfortunately the cost of standing up a public drug manufacturer is insane. The reputational cost to Canada of cancelling patents would also be terrible.

Besides, Canada's mechanism for controlling patented drug prices is the PMPRB. Leverage them better instead.
