A group of NHS clinicians responsible for registries holding health information on millions of patients are warning of the risk of a major data breach through an NHS England project they claim has neglected basic IT security measures. The programme to set up an Outcome Registries Platform (ORP) has received little attention outside the NHS, but once complete, it will see over 30 clinical registries comprising disparate highly sensitive, special category datasets that currently are held separately, moved into a single centralised repository, with the aim of improving patient care. However, ORP is currently accessible via the public-facing internet, rather than being located on the secure Health and Social Care Network (HSCN), and is not protected by multi-factor authentication (MFA), which is stipulated by NHS security protocols.

5.1.3 AGD noted that when the 'OpenSAFELY: all research analyses and participants who have consented for studies – Briefing Paper' was discussed by interim AGD on the 28th September 2023, a number of points had been made that were still relevant to this Direction and accompanying papers, including, but not limited to, transparency from the perspective of citizens whose data was being used; ongoing communication with the GP profession, including the GP Data Protection Officers (DPOs); and further stakeholder engagement via already established networks within NHS England, for example, the DPO webinars with GP DPOs. AGD suggested that NHS England review the advice given in September 2023 in conjunction with the advice given at this meeting. 5.1.4 It was noted by NHS England that the ongoing engagement / transparency would be undertaken concurrently with the progression / launch of the Direction; however, it was suggested by the Group, that the Direction does not progress further without a communication / engagement plan being in place.

Louis Mosley appeared in front of the Science, Innovation and Technology Committee on Tuesday as part of its innovation showcase. While there, he also challenged claims that Palantir has a "reputational difficulty" and said it is "very proud" of the work it does in Israel. Palantir was co-founded by billionaire tech entrepreneur Peter Thiel, who was an early backer of US President Donald Trump, and has worked with the US government. It was announced in November 2023 that a group led by Palantir had secured a £330 million contract to provide the NHS Federated Data Platform (FDP).

The Bill (clause 77) disapplies the existing requirement to provide information to data subjects when personal data is processed for a further, separate, purpose if it is for scientific research and would require 'disproportionate effort' to provide this information. We are deeply concerned that this provision will water down the transparency of information to patients. Any reduction in transparency requirements is a backward step in terms of promoting confidence in the use of health data, given the very close relationship between transparency and public trust. It contradicts the approach in the recently published ICO guidance about improving transparency in health and social care. Disapplying transparency requirements is contrary to societal expectations – more, not less, transparency is required to build and maintain public trust – and reducing transparency is also in direct contradiction to the National Data Guardian's (NDG) advice that there should be 'no surprises' for patients about how and why their data is used.

NHS England has published this Notice in relation to securing a training certification option to accredit those working in information governance in health and care. NHS England is seeking to locate a provider who already has a suitable training certification option available that would require minimal development work to make it appropriate to NHS England's needs. NHS England is not looking to commission a major piece of development work for this purpose. This will be a pro-bono arrangement in which NHS England will offer its expertise and IG engagement channels for certificate promotion purposes in return for a provider offering their training services and sharing their existing course materials in a collaborative project to provide a certificated IG in health and care training offer to IG professionals working in health and care in England.
