REME COURT OF THE UNITED STATES _________________ No. 25A319 _________________ DONALD J. TRUMP, PRESIDENT OF THE UNITED STATES, ET AL. v. ASHTON ORR, ET AL. ON APPLICATION FOR STAY [November 6, 2025] This case concerns an Executive Branch policy requiring all new passports to display an individual’s biological sex at birth. The United States District Court for the District of Massachusetts preliminarily enjoined the Government from enforcing the policy, and the First Circuit declined to stay the injunction pending appeal. The Government then filed this stay application. Applying our familiar stay fac- tors at this preliminary stage, we grant the application. Displaying passport holders’ sex at birth no more offends equal protection principles than displaying their country of birth—in both cases, the Government is merely attesting to a historical fact without subjecting anyone to differential treatment. And on this record, respondents have failed to establish that the Government’s choice to display biological sex “lack[s] any purpose other than a bare . . . desire to harm a politically unpopular group.” Trump v. Hawaii, 585 U. S. 667, 705 (2018) (internal quotation marks omitted). Nor are respondents likely to prevail in arguing that the State Department acted arbitrarily and capriciously by de- clining to depart from Presidential rules that Congress ex- pressly required it to follow. See 22 U. S. C. §211a. For these reasons, the Government is likely to succeed on the merits. And the District Court’s grant of class-wide re- lief enjoins enforcement of an Executive Branch policy with foreign affairs implications concerning a Government docu- ment. In light of the foregoing, the Government will 2 TRUMP v. ORR JACKSON, J., dissenting “suffer[] a form of irreparable injury” absent a stay. Trump v. CASA, Inc., 606 U. Should certiorari be denied, this stay shall termi- nate automatically. In the event certiorari is granted, the stay shall terminate upon the sending down of the judg- ment of this Court. These consolidated cases address President Trump’s lawful imposition of tariffs under the International Emer- gency Economic Powers Act (IEEPA), Pub. L. No. 95- 223, Tit. II, 91 Stat. 1626 (50 U.S.C. 1701 et seq.), which the President, in his exercise of power over the military and foreign affairs, has determined are necessary to rectify America’s country-killing trade deficits and to stem the flood of fentanyl and other lethal drugs across our borders. To the President, these cases present a stark choice: With tariffs, we are a rich nation; without tariffs, we are a poor nation. The President has stated that “[o]ne year ago, the United States was a dead coun- try, and now, because of the trillions of dollars being paid by countries that have so badly abused us, America is a strong, financially viable, and respected country again.” CAFC Doc. 154, at 1 (Aug. 11, 2025).* “Sud- denly revoking the President’s tariff authority under IEEPA,” he warns, “would have catastrophic conse- quences for our national security, foreign policy, and economy.” Ibid. The President has made clear that “[i]f the United States were forced to pay back the trillions of dollars committed to us, America could go from strength to failure the moment such an incorrect deci- sion took effect.” Id. at 1-2. In short, President Trump and his advisors have de- termined that erroneously invalidating the IEEPA tar- iffs “would have catastrophic consequences for our na- tional security, foreign policy, and economy.” CAFC Doc. 154, at 1. The President observes that “[t]hese deals for trillions of dollars have been reached, and other coun- tries have committed to pay massive sums of money,” ibid.—which, he projects, could reach $15 trillion. The President has emphasized: “If the United States were forced to unwind these historic agreements, * * * the economic consequences would be ruinous, instead of un- precedented success.” Id. at 1-2.

Br.); see id. at 56-61; CAFC Doc. 100, at 41-45 (July 8, 2025) (Oregon C.A. Br.); DDC Doc. 9, at 43-46 (Apr. 24, 2025) (Learning Resources Mot. for Prelim. Inj.). No lower court accepted those arguments, and for good reason. Setting aside the compelling justifications for the emergency declarations reflected in the Executive Or- ders and the sworn statements of four Cabinet-level of- 42. ficials, the President's determinations in this area are not amenable to judicial review. Judges lack the insti- tutional competence to determine when foreign affairs pose an unusual and extraordinary threat that requires an emergency response; that is a task for the political Branches. The NEA and IEEPA delegate to the Pres- ident the authority to declare and respond to emergen- cies, and "[hlow the President chooses to exercise the discretion Congress has granted him is not a matter for our review." Dalton v. Specter, 511 U.S. 462, 476 (1994). That both the NEA and IEEPA include various con- gressional reporting requirements underscores that Congress envisioned itself, not the courts, as the princi- pal monitor of the President's exercise of authority. It is unclear how courts could meaningfully review an emergency declaration or determination of an unu- sual and extraordinary threat, given that Presidents are neither agencies nor required to provide detailed rea- sons for their decisions. Cf. Hawaii, 585 U.S. at 685- 686; Franklin v. Massachusetts, 505 U.S. 788, 827 (1992) (Scalia, J., concurring in part and in the judg- ment). Presidents often have made their determina- tions in a single sentence-including in the very first IEEPA action, undertaken in response to the Iranian hostage crisis of 1979, in which President Carter simply declared that "the situation in Iran constitutes an unu- sual and extraordinary threat." 44 Fed. Reg. at 65,729; see Executive Power With Regard to the Libyan Situa- tion, 5 OLC Op. 432, 434 (1981) ("A presidential decla- ration of emergency under IEEPA can be short and to the point."). Even if judicially manageable standards could be found, review of presidential determinations would have to be highly deferential. See Hawaii, 585 U.S. at 686; 6:15 •l 5G 80 supremecourt.gov 43 Wald, 468 U.S. at 242; Agee, 453 U.S. at 292. The Pres- ident indisputably complied with the NEA's procedural requirements in declaring the relevant emergencies here. See 50 U.S.C. 1621, 1622, 1631, 1641. And con- trary to plaintiffs' assertions, nothing in the NEA or IEEPA precludes emergencies resulting from "long- standing" threats. The 1979 hostage-crisis emergency, for example, is still "ongoing." Notice of Nov. 1, 2024, 89 Fed. Reg. 87,761 (Nov. 4, 2024). Nor does IEEPA estop a President from responding to longstanding but theretofore unaddressed threats that eventually rise to the level of an emergency. Pres- idents have used IEEPA to respond to longstanding threats ranging from South Africa's "policy and prac- tice of apartheid," Executive Order No. 12,532, 50 Fed. Reg. 36,861 (Sept. 10, 1985), to global "human rights abuse and corruption" whose "prevalence and severity" had "reached such scope and gravity that they threaten[ed] the stability of international political and economic systems," Executive Order No. 13,818, 82 Fed. Reg. 60,839 (Dec. 26, 2017). Here, "President Trump and his senior economic advisors concluded that decades of cumulative, uncorrected trade imbalances had brought the United States to a 'tipping point,' i.e., the brink of a major economic and national-security ca- tastrophe." Mot. to Expedite 2a (Bessent). Those con- clusions warrant judicial respect, not second-guessing. II. IEEPA DOES NOT VIOLATE THE NONDELEGATION DOCTRINE IEEPA's authorization of tariffs does not amount to "a functionally limitless delegation of Congressional taxation authority" in violation of the Constitution. Pet. App. 58a; see id. at 169a-172a.

According to Flock’s announcement, its Ring partnership allows local law enforcement members to use Flock software “to send a direct post in the Ring Neighbors app w/details about the investigation & request voluntary assistance.” Requests must include “specific location & timeframe of the incident, a unique investigation code, &details about what is being investigated,” and users can look at the requests anonymously, Flock said. “Any footage a Ring customer chooses to submit will be securely packaged by Flock and shared directly with the requesting local public safety agency through the FlockOS or Flock Nova platform,” the announcement reads. Flock said its local law enforcement users will gain access to Ring Community Requests in “the coming months.” A flock of privacy concerns Outside its software platforms, Flock is known for license plate recognition cameras. Flock customers can also search footage from Flock cameras using descriptors to find people, such as “man in blue shirt &cowboy hat.” Besides law enforcement agencies, Flock says 6,000 communities & 1,000 businesses use their products. For years, privacy advocates have warned against companies like Flock. This week, US Sen. Ron Wyden (D-Ore.) sent a letter to Flock CEO Garrett Langley saying that ICE’s Homeland Security Investigations (HSI), the Secret Service, & the US Navy’s Criminal Investigative Service have had access to footage from Flock’s license plate cameras. “I now believe that abuses of your product are not only likely but inevitable &that Flock is unable &uninterested in preventing them,” Wyden wrote. In August, Jay Stanley, senior policy analyst for the ACLU Speech, Privacy, &Technology Project, wrote that “Flock is building a dangerous, nationwide mass-surveillance infrastructure.” Stanley pointed to ICE using Flock’s network of cameras, as well as Flock’s efforts to build a people lookup tool w/data brokers. … Matthew Guariglia, senior policy analyst at the Electronic Frontier Foundation (EFF), told Ars via email that Flock is a “mass surveillance tool” that “has increasingly been used to spy on both immigrants and people exercising their First Amendment-protected rights.” Flock has earned this reputation among privacy advocates through its own cameras, not Ring’s. An Amazon spokesperson told Ars Technica that only local public safety agencies will be able to make Community Requests via Flock software, and that requests will also show the name of the agency making the request. A Flock spokesperson told Ars: Flock does not currently have any contracts with any division of [the US Department of Homeland Security], including ICE. The Ring Community Requests process through Flock is only available for local public safety agencies for specific, active investigations. All requests are time and geographically-bound. Ring users can choose to share relevant footage or ignore the request. Flock’s rep added that all activity within FlockOS and Flock Nova is “permanently recorded in a comprehensive CJIS-compliant audit trail for unalterable custody tracking,” referring to a set of standards created by the FBI’s Criminal Justice Information Services division. But there’s still concern that federal agencies will end up accessing Ring footage through Flock. Guariglia told Ars: Even without formal partnerships with federal authorities, data from these surveillance companies flow to agencies like ICE through local law enforcement. Local and state police have run more than 4,000 Flock searches on behalf of federal authorities or with a potential immigration focus, reporting has found. Additionally, just this month, it became clear that Texas police searched 83,000 Flock cameras in an attempt to prosecute a woman for her abortion and then tried to cover it up. Ring cozies up to the law This week's announcement shows Amazon, which acquired Ring in 2018, increasingly positioning its consumer cameras as a law enforcement tool. After years of cops using Ring footage, Amazon last year said that it would stop letting police request Ring footage-unless it was an "emer-gency"-only to reverse course about 18 months later by allowing police to request Ring footage through a Flock rival, Axon. While announcing Ring's deals with Flock and Axon, Ring founder and CEO Jamie Siminoff claimed that the partnerships would help Ring cameras keep neighborhoods safe. But there's doubt as to whether people buy Ring cameras to protect their neighborhood. "Ring's new partnership with Flock shows that the company is more interested in contributing to mounting authoritarianism than servicing the specific needs of their customers," Guariglia told Ars. Interestingly, Ring initiated conversations about a deal with Flock, Langely told CNBC. Flock says that its cameras don't use facial recog-nition, which has been criticized for racial biases. But local law enforcement agencies using Flock will soon have access to footage from Ring cameras with facial recognition. In a conversation with The Washinaton Postins monm Calli Schroeder senior counsel at the consumer advocacy and policy group Electronic Privacy Information Center, described the new feature for Ring cameras as “invasive for anyone who walks within range of” a Ring doorbell, since they likely haven’t consented to facial recognition being used on them. Amazon, for its part, has mostly pushed the burden of ensuring responsible facial recognition use to its customers. Schroeder shared concern with the Post that Ring’s facial recognition data could end up being shared with law enforcement. Some people who are perturbed about Ring deepening its ties with law enforcement have complained online.
