On November 21, 2024, the FCC released a Public Notice seeking comment on a request by the U.S. Department of State to allow Video Relay Service (VRS) users to make calls to U.S. embassies and consulates while VRS users are traveling abroad and to allow such calls to be compensable from the Interstate Telecommunications Relay Services (TRS) Fund. Currently, the Commission does not allow compensation from the TRS Fund for international VRS calls where both endpoints are outside the United States. The State Department has asked the Commission to whitelist official State Department telephone numbers and to authorize VRS providers to connect calls to U.S. embassies and consulates worldwide. The State Department claims that its dedicated consular teams around the world stand ready to coordinate help on a 24/7 basis for U.S. residents who need assistance due to a medical emergency, lost passport, death, arrest, or other unanticipated event. The State Department seeks to ensure that deaf and hard of hearing individuals who use VRS have access to these services. SpaceX replied to Echostar with this FCC filing. Typical bluster. $SATS $ASTS. I suspect AT&T and Verizon are monitoring SpaceX signals but we won't see anything for a little while. SpaceX D2D sucks even with the OOBE waiver IMO.

SAT-MOD-20230207-00021 and SAT-AMD-20240322-00061 Dear Ms. Dortch: While EchoStar’s defense of its application to limit the service SpaceX can provide Americans that depend on its direct-to-device operations is long on rhetoric, it is short on substance.1 For example, EchoStar still has not provided any data to substantiate its claims of harmful interference from the out-of-band emissions (“OOBE”) waiver granted to SpaceX.2 Perhaps that failure is because EchoStar makes, at best, de minimis use of its AWS-H block spectrum.3 In the few instances where EchoStar does at least try to respond to SpaceX’s substantive points, EchoStar mischaracterizes Bureau precedent in an effort to have different waiver standards apply to its competitors than to itself. The Commission can easily reject EchoStar’s attacks and remove the cloud over American consumers and first responders that rely on robust and reliable direct-to-cellular service. For example, EchoStar falsely claims that the Space Bureau and Wireless Telecommunications Bureau did not determine whether the OOBE waiver would result in harmful interference to other operators.4 But the Bureaus in fact did find good cause to grant the waiver “based on the record before us” and found that this approach would “protect[] terrestrial wireless services in their current and future configurations.” 5 EchoStar ignores both the plain language of the Bureau Waiver Order and SpaceX’s arguments.6 Instead, EchoStar tries to justify why it should be entitled to a series of other waiver orders it received, even though many of those waivers lack the definitive non-interference statement it claims the Commission was required to provide in Page 2 of 3 approving SpaceX’s Bureau Waiver Order.7 EchoStar offers no reason to subject SpaceX’s waiver—a waiver the Chairman has hailed for its benefits to the American people8—to a higher bar than EchoStar’s own waivers. EchoStar also repeats its false, absolutist claims that the Commission’s standard practice of requiring waiver recipients to address any interference that might arise contravenes the statutory mandate of Section 303(f) of the Communication Act because, in EchoStar’s reading, the statute requires the Commission to prevent all harmful interference before it starts.9 As an initial matter, the D.C. Circuit has rejected EchoStar’s maximalist view, finding that the Commission need not “eliminate all risk of harmful interference” in its decisions, and may rely on probabilistic studies in place of worst-case analyses when authorizing new, secondary services.10 In any event, SpaceX’s analysis demonstrated that it would not cause harmful interference to adjacent band services based on fundamental physics equations and under conservative assumptions, including idealized handset characteristics and the generally accepted wireless interference protection threshold that the Commission has found does not constitute harmful interference. With respect to the particular condition EchoStar challenges here, the Commission has imposed that condition even where it has concluded that a waiver would not result in harmful interference, including in two waivers granted to EchoStar as examples.11 Indeed, the very rule that imposes the OOBE limit contemplates that SCS operations could nonetheless result in harmful interference that “may require a greater attenuation of the emission than specified in this section.”12 EchoStar did not respond to these points—but instead simply continued to assert its absolutist position with respect to Section 303(f) without trying to square that position with its own authorizations.13 Unfortunately for EchoStar, ignoring contrary evidence w…

In the redacted portion of the July ODAR Supplement, AST SpaceMobile provides NASA Debris Assessment Software (“DAS”) input data used to calculate its satellites’ cross-sectional area.3 The DAS input data consists of the spacecraft’s component shapes and their point coordinates, mapped against a common coordinate system. See, e.g., Figure 1. DAS uses this information to create a spacecraft map, or estimated configuration, and calculate the spacecraft’s cross-sectional area.

The constellation will provide the first and only global cellular 5G broadband network in space designed to operate directly with standard, unmodified mobile devices. To enable AST SpaceMobile and the U.S. commercial space industry to successfully compete across the globe, the FCC must act now—as Chairman Carr has recognized—to remove costly, unnecessary, and duplicative regulations and processes. This will allow the FCC to keep pace both with the rapidly evolving space ecosystem, and rival nations investing heavily in their space programs with little or no regulatory backstop. Accordingly, AST SpaceMobile recommends the following: o Surety Bonds Should Be Deleted (47 C.F.R. § 25.165): The FCC’s surety bond requirement for satellite licensees (but not market access grantees) fails to achieve its intended goal and serves as a high barrier to entry for innovative American firms, essentially acting as a tax.  The United States is the only country with this requirement and operators often simply walk to another country to escape this tax.  The surety bond requirement has outlived its usefulness. Two decades after its adoption, advances in technology, decreasing costs, and more readily available launch services have ameliorated the original concern about speculative spectrum warehousing. o Overly Burdensome Part 25 Rules Should Be Deleted:  47 C.F.R. § 25.113(i): Delete the notification and certification provision. Given the Commission’s determination that replacement satellites do not require modification, as they do not increase interference or otherwise require affirmative Commission … 3 ACTIVE 711767551v3  Shot clocks for Part 5 experimental licenses and requests for Special Temporary Authority (“STA”): • The Commission should adopt a 15-business day (for spectrum not shared with government users) and 20-business day (for shared spectrum) shot clock for action, after which the STA would be deemed granted. • For new Part 25 STA requests, the Commission should establish a 10- business day shot clock for taking final action in non-shared bands, and a 15-business day shot clock in shared bands. • For Part 25 STAs, applications for renewal should be filed for notification purposes only and deemed granted 1-business day after filing. o The Practice Of Imposing License Conditions That Expand The Scope Of The FCC’s Rules Should Be Deleted: The FCC should delete the practice of imposing bespoke or duplicative conditions on space station and Earth station licenses, except as necessary to address waivers of the Commission’s rules. This practice creates a patchwork of inconsistent regulation on a per-satellite basis that imposes significant compliance costs on operators’ many licensed satellites. It also functions as a regulatory ‘backdoor’ for adding new requirements that deprive industry and the Executive branch of the necessary process to ensure that regulation advances the public interest.  The Commission should cease its practice of withholding authorization for the full number of satellites requested in an application and instead condition those licenses on making modifications that find no basis in Commission rules.  The Commission should also discontinue its practice of imposing Part 25 requirements on experimental authorizations via conditions. o Certain Rules Related To The 5G Fund Should Be Deleted: Various aspects of the rules governing the 5G Fund should be revised to reduce regulatory burdens.  First, any provider capable of meeting the 5G mobile performance requirements should be eligible for the 5G Fund Auction.  Second, the FCC should a…
