In CIPA news, Rodriguez v. Culligan is a fun new case out of S.D. Cal holding that A) as in Popa v. Microsoft, invasion of privacy alone doesn't create standing under Spokeo, there needs to be a harm; and B) internet users have no expectation of privacy in.......

CIPA inherently meant the schedule would've been drawn out if it made it to trial, but the evidence was rock solid, and but for Cannon/Trump's ability to bankroll his co-conspirators' JDA-style defense (leveraging them against cooperation), there'd have been a strong incentive for him to plead out.

The deadline for filing a Sec. 4 CIPA motion isn't until 11/4. That's literally the first sealed motion anyone should even think about filing.

Unless DOJ is so eager to get done with CIPA that it filed the motion 3 weeks ahead of schedule, one day after setting the schedule.
Not even a week in and prosecutors in the Jim Comey case have SEKRITS.

I'd give at least a 25% probability that the judge requires this unsealed (there's no sign of permission to sign it under seal).

Maybe it's about Trump's fee fees.

If it were CIPA, it wouldn’t even show up on the docket—those are ex parte, paper only, and there’d be a slipsheet filed to show that the CISO delivered everything to the SCIF. This is something different, and probably dumber.

At one point during the hearing, the judge asked the prosecution why the case can’t be tried before mid-December.

Lemons replied: We are “just getting our hands around” discovery in the case.

There’s lots of it, he added, and it includes a “significant” amount of classified information.
