Having litigated one of the seminal "do you have good cause to skip notice-and-comment rulemaking?" cases in the CADC, the justification for invoking the good-cause exception is really flimsy here.

Next democratic congress under President AOC should pass that law, and then expand DDC since it's going to get a much higher case load and also expand CADC for the same reason. Seems fair to me.

A CADC oral argument I worked on once paused the Roger Clemens trial for a morning because I had a colleague on the jury who worked on the case and the lawyers didn't want to alienate a juror by saying she couldn't go watch.

But I could imagine four of them voting to grant cert (even though they know they'll lose the merits case) to get the end of the trial delayed past election day.
Though I suppose (?) that once cert is granted (even in the same order?) the other 5 could simply say "fine, cert granted, CADC upheld"

There actually is some ambiguity in the CAA language as applied to GHGs, but CADC dodged that question on standing. Court is reviewing the standing issue, not the merits.

ATF puts up pole camera to watch public courtyard where drug sales occurring. 2 days later, local cops review footage & see suspect leave home. CADC: No 4A search here, it's public observation. Mosaic theory doesn't apply; it's just a fixed camera, & 2 days.

The act of NOT taking this when it was first floated to them and then taking it when the CADC issued an authoritative opinion in itself should be considered a decisively political act that condemns the Court.
even if we avoid the worst consequences of this decision — which, as rick says, involve trump getting elected and then pardoning himself for his attempted coup (and likely trying again) — the court's actions should be seen as grounds for dramatic action to curb its power
