Okay Creative Commons, ELI5, what does the Credit signal do that the Attribution portion of CC-BY(-NC)(-ND) doesn't? Like the existing Creative Commons suite is a norm-setting project! You spent several pages being like wow...them AI folks rly don't care about Internet norms...so how does this help?
Credit: You must give appropriate credit based on the method, means, and context of your use.

All of this is true but I still think there's a distinction to be drawn between say a TDM based research project on shifts in, idk, romance novel conventions over time, and OpenAI inhaling Julia Quinn's whole corpus so someone can pay $50 to sneak romance novel slop past Kindle customers.
There are certainly scenarios where AI training and deployment constitutes copyright infringement; the lines here vary by jurisdiction and context and are actively undergoing litigation.84 However, we know the current state of copyright law around the world does not grant rightsholders universal authority to control use of their works for AI training. In the United States, the doctrine of fair use generally protects analysis of existing works to extract non-copyrightable elements. The European Union (EU) has an exception for TDM for certain research and cultural heritage institutions, while allowing others to perform TDM so long as they abide by specific, machine-readable reservations made by rightsholders. More to the point, copyright shouldn’t grant universal authority to control use of works for AI training in all scenarios. This would mean granting a monopoly over ideas, genres, and facts. Expanding property rights risks further concentration of power, both in AI development and beyond. And, given that many content creators and artists sign away their copyrights to large companies, the main beneficiaries of more restrictive copyright laws and licensing deals would be large rightsholders, not creators themselves.

Weren't the last 19 pages of this all about how AI developers are not in fact willing to abide by clear signals of creators intent? 🤔 I too sometimes find it strategically useful to be like of COURSE you're going to do the right thing at people but I don't think that works with motivated bad actors?
It’s clear that AI developers need this, too. Many examples of new, generative AI-powered tools decline to answer queries to avoid accessing news content they are permitted to access, while answering queries using content they shouldn’t be accessing. As we’ve written before, responsible technology developers share an interest in defining better ways to respect creators’ wishes. If they could get a clear signal of the creators’ intent, then they would follow it.

I mean sure but like. Doesn't that suggest a need to start enforcing consequences on 'AI reuse'? Like yep, they sure are bad actors! Ignoring NC terms to hoover up content for your for-profit company sure seems like should be catching lawsuit style hands!
In addition, we’ve seen a worrying trend among some academic publishers who control public access to research toward more restrictive CC licenses, in the hopes that it will restrict AI training on published materials. Cambridge University Press has said that “historically for books, our default open access license was a CC BY-NC license… [but] we are now looking at using more CC BY-NC-ND as the default.”50 This shift is being led by organizations such as the British Academy.51 These attempts are misguided, because they impede the ability of humans to make full use of the materials, thus limiting access to knowledge, while simultaneously providing ineffective control over machine reuse.

The academics who get it, get it!!
What Was Challenging If I had to sum up all the frustrations withthe pro-ject and why the work ended when the grant fund-ing ended,it would be bureaucracy.There were struggles navigating each university’s procedures and regulations that created frustration and eventu-ally, in many ways,inhibited future collaboration. The firstbarrier, or at least frustration, from the VT and UVM side was the bane of academics-compliance culture.This played out in several dis-tinct ways on thevarious trips when teams from one region visited another.To be clear, compliance regulations have a pur-pose.They exist to prevent fraud and embezzle-ment, for example, and to ensure that taxpayer-funded grant money is spent responsibly. There are places, however, where “one-size-fits-all”rules can at best cost a great deal of time and effort and,worse,disincentivize actions which advance the implicit goals of the collaboration. I will detail the issues below and then discuss a few lessons learned.
